League Receives Reply from DOLI on Vaccine Mandate Question

The state Department of Labor and Industry has replied to a League letter asking that costs associated with COVID testing under the federal Occupational Safety and Health Administration's (OSHA) Emergency Temporary Standard not be borne by those state's employers that would fall under the ETS.

As of Nov. 16, 2021, litigation related to the Federal OSHA vaccine mandate emergency temporary standard (ETS) for employers with 100 or more employees, was moved to the 6th Circuit Court of Appeals via the lottery process. The 6th Circuit Court of Appeals will now likely not rule on the ETS until sometime after Dec. 10, which is past the initial deadlines set in the ETS. The state has pressed pause on the mandate until the federal courts decide the legality of certain issues.  

DOLI notes that it is consulting with the Office of the Attorney General on the question we posed related to testing costs. Once a response is received, a Frequently Asked Question will be posted to the DOLI webpage covering the ETS.
